Will of Joel S. Earles, Deceased

The following instrument of writing purporting to be the last Will and Testament of Joel S. Earles, late of Union Township, in this County, deceased, was produced and filed herein May 19th 1919, towit:

Last Will and Testament

I, Joel S. Earles of Getaway, Lawrence County, Ohio, being of sound mind and disposing mind and memory, considering the uncertainty of continuance in life, and desiring to make such disposition of my worldly estate as I deem best, do make, publish, and declare this to be my last Will and Testament, hereby revoking any and all former wills and codicils whatsoever by me made.

First: I desire that all my just debts and funeral expenses be paid as soon as practicable after my decease;

Second: I give and bequeath to Sarah Caple, and her heirs, the undivided one half of all furniture and household goods which I may have at my decease;

Third: I will, give and bequeath to Sarah Jane Morrison the undivided one half of all furniture and household goods which I may have at my decease;

It is my will and I desire that Mrs. Sarah Caple and Mrs. Sarah Jane Morrison shall amicably divide the household goods and furniture, each being fair with the other.

Fourth: I will, give and devise to Sarah Caple, and her heirs, my home place, consisting of the homestead and about seven acres of land, more or less, situated in Getaway, Lawrence County, Ohio, and if I should sell any off of the same during my lifetime, the remainder of the same shall be hers under this devise. The above bequest and devise given to Mrs. Caple is out of consideration of her and her husband’s kindness, attention, and care of the undersigned up to this time and for the same kindness, care and attention during the remainder of my life.

I nominate and appoint Edward Snyder to be the executor of this Will.

In Witness Whereof, I have hereunder set my hand this 26th day of June in the year One Thousand Nine Hundred and Eighteen (1918). Joel S. Earles

Signed, published and acknowledged by the said Joel S. Earles as and for his last Will and Testament, in our presence, and subscribed and attested by us, as witnesses in his presence and at his request.

Getaway, Ohio, February 17, 1919.

Desiring to make an addition to my will of date June 26, 1918, and the same being on the opposite of this sheet of paper, I add to it the following codicil:

I will and bequeath to Sarah Jane Morrison and Mrs. Sarah Caple, share and share alike, all personal property, moneys, credits, notes, bonds, stocks, which I may own at my decease; the remainder of my Will to remain exactly as drawn.

In witness whereof, I have hereunto set my hand this 17th day of February A. D. 1919. Joel S. Earles

Signed, published and acknowledged by the said Joel S. Earles as and for his codicil to his last Will and Testament in his presence and subscribed and attested by us as witnesses in his presence and at his request.

Your petitioner respectfully represents that Joel S. Earles, late a resident of the Township of Union in the said County, died on or about the 9th of May A. D. 1919, leaving an instrument in writing, herewith produced, purporting to be his last Will and Testament: That the said decedent died leaving no widow and the following next of kin, towit:
